Nick F40 Posted January 22, 2009 Posted January 22, 2009 (edited) So I heard from http://grassrootsmotorsports.com/forum/grm...ain/6678/page1/ that Shelby is trying to sue Factory Five Racing for "trade dress" use. I don't get it, I thought he was fine with it. They are called a Roadster not Cobra and the Daytona Coupe as 65 Coupe and wasn't the Daytona Coupe a copied design, like the one post comparing the E Type or the Ferrari 250 to the Daytona Coupe which it does highly. I don't get it. "Unregistered trademark" uhhh, so I thought it had to be registered to be a trademark so in that case you shouldn't female dog if some else uses it. I agree on all the posts. Didn't this happen..before? I like how they want to trademark all these things. I want the letter N and Ferrari and FIA and WRC and ALMS....... Edited January 22, 2009 by Nick F40
RyanSilva Posted January 23, 2009 Posted January 23, 2009 See the new 33 "hot rod" from FACTORY fIVE? made to outrun the cobra kit cars..and keep up/out run zo6's!
Pete J. Posted January 23, 2009 Posted January 23, 2009 Shelby is just a plain jerk! He has been trying to claim credit for anything he can for as long as he can. Sues anyone he can for the bucks and has tried to cheat is way in an out of more things. I remember he got in a lot of trouble in the 90's for building some cobra chassis's and setting them out to rust and then claiming they were old chassis's he never had time to build. That way he could get around a whole bunch of regulation. The man is a pot calling all the kettles around him black. He just annoys the whole racing and car building community. Not much respect for the man!
lordairgtar Posted January 23, 2009 Posted January 23, 2009 Methinks his chili fixin's have destroyed a few remaining brain cells he has left.
whale392 Posted January 23, 2009 Posted January 23, 2009 Should have stuck to chicken farming. He wasn't even that good of a racer, he just had good talent drive for him.
OneTrickPony Posted January 23, 2009 Posted January 23, 2009 (edited) Didn't this happen..before? Shelby sued F5 over the Cobra body shape and the use of the Cobra name. Now he is doing the same over the Daytona Coupe and is also sueing their independant user site ffcobra.com. He got very little off the first suit except for them dropping the Cobra name from their replica. He stole the body shape of the Cobra from several European sports cars. Nick F40 Posted January 23, 2009 Author Posted January 23, 2009 Well Factory Five has the name changed for both of them and that's waht some are saying, the Cobra was stole from different vehicles in the 60's and even from AC in the 50's and the Daytona Coupe looks a lot like a few that comes to mind, like the ones I listed.
