I bought a kit on Ebay, and when the kit arrived, it was not even close to what the listing said, listing said it was new, unbuilt, well what I got was a 90% built kit, plus a bunch of other parts from other kits, as well as body from another kit.

So anyways, I contacted the seller, trying to get him to refund my money, I told him i will ship the kit back to him, he dose not seem to care if I do. On top of that, he knew it wasn't, and he reminded me, I got a great a deal, yep he is right, if it was an unbuilt kit.

I have not heard back from the seller in a few days, so how long should I give the seller before I do a paypal claim/ebay claim. I have been lucky so far, have not really had that many problems like this.

Don't wait ! If the seller is not willing to solve any issue you have , then go to the Resolution Center on ebay and open a case .

I buy and sell regularly on Ebay , and the only reason a seller won't cooperate is if he knowingly listed or sold an item that was not as described . This is very rare , but there are always bad apples . I've never had any problems with sellers so I can't say how long the process will take . I have had several problems with buyers and it usually takes 7 to14 days .

Before I would give any advice I'd want to see the original listing. If everything is as you say, here's something I saw one dissatisfied buyer do. He photographed the model he received along with the original sellers description and put on ebay as an auction. The seller contacted him shortly after the auction hit and agreed to refund the money.

I would go ahead and file an item not as described claim if he isn't willing to refund your money. That will get his attention and may prompt him to refund your money. I've only had one bad deal on ebay,but I did get my money refunded by ebay.

Contact the seller and tell him you will open a case, remind the seller about (copy and paste) his message, also take a screenshot of the ebay page. Wait a couple of days and after if he did not reply open a case.

Go ahead and file while you can still pull up the original listing, that is your evidence. Shoot some pics of what actually showed up and get started.

If a refund or some agreement has not been reached within 24 hours of notification, a claim should be filed in my opinion.

Since you've spoken with him and know he is aware of the situation, I would say that any responsibility or desire you may have at offering courtesy has been fulfilled.

I know you stated filing an eBay/PayPal claim, so I'm sure that was your method of payment, but, as a note, eBay buyer protection essentially exists only when PayPal is used.

Your rights only have a limited window of enforcement in most states. Waiting is the enemy. If you feel you are the victim of deceptive advertising, take action forthwith.

Hey guys, been moving, having to post this from my phone, I did open a. Dispute on paypal as well as ebay, I did the ebay claim soon as I got the kit.

Tell him no, you want a full refund, and that's it. There's no question negative feedback should be left in this case, so that you can warn others this seller is not to be trusted.

I have to agree, it isn't like there was a minor ommission or miscommunication, he blatantly misrepresented a used and mostly assembled kit as brand new.

The $10 refund is fair I think since it will cost you $8-$10 in postage to get your $20 back from paypal. And you can salvage something of value from the junk kit he sent. So you are only getting $10-$12 back whether you keep the kit or not.

But not with a stipulation on feedback! Get him to remove the stipulation and tell him you will leave HONEST feedback about the pile of excrement he sold as a "new, unbuilt" kit.

I am not good at math, but if I take his $10 offer, and it cost's me $8-10 to ship it back to him, I am getting $0 back, if I get my $19.99 back, I will get at least something back.

I would have to make him pay to ship it back too. If you only get your 19.99 back and then have to spend 7-10 to send the kit back you aren't whole, you are still out shipping. In this situation you shouldn't have to be liable for return postage since there misrepresenatation was so gross. If you do have to pay for postage I would grind the kit up in a food processor until it will fit in a small padded envelope so your shipping will only be a couple of bucks.

Didn't he offer a $10 refund AND you KEEP the kit? Not saying that's fair, but that's how I read it. I think you should get the full refund AND keep the kit. I had a simular issue before. The seller gave me a full refund and said not to worry about sending the items back.

Yes he did, I have had some sellers do the same thing, I think he does not want to be stuck with it anymore then I do :lol:

Make a claim and you will get all your money back, shipping too.

That's why I never buy from anyone with less that 99 percent positive feedback or better.
