I think this nails it. I agree that it seems like double jeopardy Harry, but they are not the same type of case. I think some tort reform is needed in this country, but the lobbyists for trial lawyers will probably not never let that happen.

I might have an AMT Extra cab dually kit that this would fit under. Not exactly correct but would save some time scratch building a front axle and changing the frame, although if I use this for a flatbed wrecker, the kit chassis would need to be extended. Hmmmm, decisions, decisions! -
Not really Greg. Look at the O.J. Simpson case for an example where one can be "innocent" in one court and guilty in the other. The burden of proof in a civil trial is much lower. What will be interesting is if the civil case ever makes it to a courtroom as many times there are out of court settlements. As hard as it is for all involved, a civil case that goes to trial will likely bring up the past of both individuals and a lot of dirty laundry might get aired that reveals things about them we either didn't know or had forgotten. In light of the disclosure yesterday that there was marijuana in the victim's system and enough to be considered "impaired", one could argue that he contributed to his own death by using illegal drugs and may have been in violation of track rules. Regardless, what happened was avoidable and lives were changed as a result. I am sure if both Tony Stewart and Kevin Ward Jr. could have a "do over", this might not have happened.

Thanks Gerry, appreciate the time you took to gather the information and share it with the forum. Glad to hear that Revell is lurking and listening, hopefully they will fix whatever problems they encounter through that monitoring of customer feedback. I agree with Harry that it would benefit them greatly to spend the time BEFORE a kit is released to ensure glaring issues are caught. I am sure they are like most companies today that are doing more with less but somehow I think they could find a couple of knowledgeable people to help them with final test shots. These could be local people with a 1:1 to compare it to or known model industry people who can research the subject for accuracy.

While the family may sue, my guess is that there will be an out-of-court settlement.

It could also be that despite some enthusiasm for the kit, the pre-orders were not there so Revell did not take a chance on running these at the time. If the reported dimensions and crudeness of the kit are to be believed, then maybe Revell did us all a favor in not releasing this kit yet. We will probably know by the end of October as to what Revell will do in 2015.

From the sounds of it, this "all new" kit is worse than the old AMT one that I have multiples of, I wonder if I should even bother opening the box, much less try building it?

There is supposedly a second video clip (that hasn't been shown to the public) that could help the Grand Jury with their decision. This is no doubt a difficult time for everyone involved as it could go either way, and none of us have seen all of the evidence so we can only speculate as to how this will go. I doubt very few residents of Ontario county have NOT heard about this incident but hopefully whomever is seated on the Grand Jury will listen to all of the testimony and review the evidence closely. Like many racing incidents, this one prompted changes to rules but also has deeply affected many people.

There will be multiple versions of this kit- long and short bed, 6 and 8 cylinder engine. I suspect that there will be 4wd versions as well as an early test shot revealed a 4wd setup. -
